We often get so caught up in the "right now" that we forget to look at the "what if."

Families come in for their conveyancing and, while we're chatting, it comes up: "Oh, I haven't looked at my Will since the kids were in nappies!" or "We bought this place together, but my Will still leaves everything to my sister."
The truth is, a Will isn't a "set and forget" document. It’s a living part of your family’s financial security. If your life has changed, your legal protection needs to change with it.
Here are the three biggest life events that mean it’s time to drop by and see us to get that Will updated.
1. The "Pitter-Patter" Factor: Growing Your Family
Whether it’s your first baby, a surprise third, or even a grandchild you want to look after, the arrival of a new family member is the number one reason to pull that Will out of the drawer.
When you have children, your Will stops being just about "who gets the car" and starts being about "who raises the kids."
Appointing Guardians
This is the part no one likes to think about, but it’s the most important decision you’ll make. If something happens to you and your partner, who do you trust to raise your children? Without a Will that specifies a guardian, that decision could end up in the hands of the courts. By making a valid Will, you ensure your kids are raised by the people you choose, in the environment you want for them.
Financial Protection & Testamentary Trusts
It’s not just about who holds their hands; it’s about how they are provided for. In Queensland, leaving a lump sum to a minor can be complicated. This is where a Testamentary Trust comes in.
Instead of your 18-year-old inheriting a house and a bank account (which, let’s be honest, might be spent on a world tour and a fast car), the assets are held in a trust. This allows for:
Asset Protection: Keeping the inheritance safe from potential future relationship breakdowns or creditors.
Tax Benefits: Distributing income to children in a tax-effective way.
Control: You can set the rules: maybe they get a portion at 21, some at 25, and the rest at 30.

2. The Big Move: Buying or Selling Property

Joint Tenants vs. Tenants in Common
How you own your property matters immensely. Most couples own as "Joint Tenants," meaning if one passes away, the house automatically goes to the other. But if you own as "Tenants in Common": common in blended families or investment scenarios: your share of the house follows your Will. If your Will is outdated, that share might go somewhere you didn't intend!
Significant Assets Change
A house is usually a family's biggest asset. If you’ve sold a property mentioned specifically in an old Will, that gift "fails," which can cause huge headaches for your executors. Updating your Will ensures that your current assets: like that beautiful new Forest Lake home: are correctly accounted for and distributed exactly how you want.

3. Relationship Transitions: Marriage, Divorce, and Separation
This is the area where Queensland law can really catch you off guard. Relationships are rarely static, and the law treats "I do" and "I’m done" very differently.
Marriage Generally Revokes a Will
Did you know that in Queensland, getting married usually automatically cancels any Will you had before? If you haven't made a new one "in contemplation of marriage," you might currently have no Will at all in the eyes of the law.
Separation vs. Divorce
This is a big one. Separation does NOT revoke your Will. If you’ve split from a partner but haven't officially divorced, your old Will: the one that probably leaves everything to them: is still legally binding.
Once a divorce is finalised, gifts to your ex-spouse are usually revoked, but why wait for the paperwork to clear? If you’re navigating a change in relationship status, updating your Wills and Estates plan is a critical step in reclaiming your independence and protecting your future.
Beyond the Will: The "While You're Still Here" Plan
While we’re talking about your Will, we’d be remiss if we didn't mention the Enduring Power of Attorney (EPOA).
A Will only works after you pass away. An EPOA works while you are still here but can’t make decisions for yourself: perhaps due to a sudden illness or accident. It allows you to appoint someone you trust to handle:
Financial Matters: Paying the mortgage, managing bank accounts, or even selling property.
Health and Personal Matters: Deciding where you live and what medical treatment you receive.
