Selling Property in Queensland? Don’t Forget Your Seller Disclosure Documents

If you're thinking of selling property in Queensland from 1 August 2025, there’s an important new legal requirement you need to know about — SELLER DISCLOSURE STATEMENT.
Under the new Property Law Act 2023, all sellers of residential property must provide specific documents to potential buyers before they sign a contract. These documents give the buyer key information about the property and are designed to make the sale process more transparent.
What Does This Mean for You as a Seller?
Before entering into a contract, sellers must now give buyers:
A Seller Disclosure Statement (in a specific format); and
A number of Prescribed Certificates, including a title search, zoning info, and other relevant notices.
This applies whether you’re selling privately, via a real estate agent, or at auction.
If you’re selling a unit, townhouse, or apartment in a community titles scheme, you’ll also need to provide:
A body corporate certificate; and
A community management statement.
Failure to provide these documents — or providing incomplete or inaccurate information — can give the buyer the right to terminate the contract, even just before settlement.

When Do You Need to Provide the Seller Disclosure Statement?
The Seller Disclosure Statement and disclosure documents must be given before the buyer signs the contract — so it’s critical to be prepared early. In auction scenarios, you must provide the disclosure documents to all registered bidders before the auction begins.
